Terms and Conditions

These Terms and Conditions ("Terms") govern your use of www.nelsonivey.com and your engagement with the travel advisory services provided by Nelson & Ivey, LLC ("Nelson & Ivey," "we," "us," or "our"). By using our website or engaging our services, you agree to these Terms.
RELATIONSHIP
In offering hotel accommodations, tour packages, villa rentals, cruise reservations, airfare, and other travel arrangements, Nelson & Ivey, LLC acts solely in the capacity of an agent and intermediary on behalf of the travel provider or supplier. Nelson & Ivey and all affiliated agents act as sales agents for any airline, hotel, car-rental company, tour operator, cruise line, or other service provider named in your itinerary ("Suppliers").
TRAVELER RELEASE
Traveler assumes full responsibility for and hereby releases Nelson & Ivey, LLC and all affiliated agents from any duty of checking and verifying all passport, visa, vaccination, and entry requirements of each destination, as well as all safety and security conditions at such destinations, during the length of the proposed travel. Please visit http://travel.state.gov/ for current entry requirements. If you are not a U.S. Citizen, please contact your embassy for applicable visa requirements.
RESPONSIBILITY
Nelson & Ivey, LLC and all affiliated agents are not responsible for the Suppliers' acts or omissions, their failure to provide services or adhere to their own schedules, or their failure to pay any refund, or for any personal injury, property damage, or other loss, accident, delay, inconvenience, or irregularity caused by any party not under our control. Nelson & Ivey shall not be responsible for any injuries, damages, or losses caused to any traveler in connection with terrorist activities, social or labor unrest, mechanical or construction failures, disease outbreaks, epidemics or pandemics, criminal acts, local laws, climatic conditions, or any other actions, omissions, or conditions outside our control.
Nelson & Ivey, LLC and all affiliated travel agents do not accept responsibility for the following:
01/ Canceled or delayed vacations and/or flights due to improper or inadequate documentation of the traveler, including but not limited to passports, visas, and vaccination records.
02/ Canceled or delayed vacations and/or flights due to poor physical or mental health of the traveler from any cause.
03/ Canceled or delayed vacations and/or flights due to mechanical failure, adverse weather, government decisions, terrorist activity, disease outbreaks, pandemics, or any other force majeure event.
04/ Canceled or delayed vacations and/or flights due to the traveler's failure to follow policies and instructions of independent suppliers or vendors, including airlines, hotels, car rental agencies, tour companies, or activity providers.
05/ Any acts or omissions of independent suppliers and vendors, including breach of contract, failure to provide services, or failure to adhere to their own schedules, whether intentional or not.
06/ Canceled or delayed vacations and/or flights due to any other reason beyond the travel agent's control.
07/ Any injury, loss, claims, or punitive, incidental, indirect, or consequential damages that occur once the traveler has embarked on their vacation.
08/ Any fees that are the direct responsibility of the traveler, including but not limited to excess baggage fees, departure taxes, tourist visas, or entry cards.
09/ Any change-of-ticket or reservation fees imposed by independent suppliers or vendors.
10/ Any refunds from independent suppliers or vendors. Nelson & Ivey will make reasonable efforts to assist in obtaining any refund owed by a travel provider should a cancellation be necessary.
11/ Any damage, loss, or delayed arrival or departure of baggage and other goods belonging to the traveler.
12/ Any transportation not previously arranged and pre-paid by Nelson & Ivey as part of the confirmed itinerary.
OUR FEE
Nelson & Ivey charges the following non-refundable planning fee:
$250 Non-Refundable Planning Deposit
This deposit is charged at the time of engagement and is non-refundable under any circumstances. It compensates Nelson & Ivey for the time and expertise invested in researching, designing, and presenting your travel experience, regardless of whether a booking is ultimately completed. This fee is not applied toward the cost of your trip.
TRAVEL INSURANCE
Nelson & Ivey strongly recommends that all clients purchase comprehensive travel insurance, including coverage for trip cancellation, interruption, medical emergencies, and evacuation. We will offer travel insurance options with every trip booked. Nelson & Ivey is not responsible for any losses that may have been covered by travel insurance.
TRAVEL DOCUMENTS
For travel booked through Nelson & Ivey, you will receive electronic confirmation via email. Documentation will include vouchers and/or final confirmation numbers for your trip. While these documents have no monetary value, you will be required to present them to your travel providers. Documents are typically delivered within two weeks of your departure date.
BAGGAGE & AIRLINE POLICIES
It is the responsibility of the traveler to understand and comply with the baggage policies and all other policies of airlines and suppliers pertaining to their travel. Nelson & Ivey is not responsible for fees or complications arising from non-compliance with supplier policies.
AGREEMENT
By engaging Nelson & Ivey for travel planning services, you confirm that all information supplied by you or members of your household is true and correct, including but not limited to legal names, dates of birth, and payment information.

Nelson & Ivey, LLC is not responsible for:
· Any third-party links contained on this website or the information contained on any linked websites.
· Any information on this website that is misleading or inaccurate, other than information provided directly about our company. All information is provided 'AS IS.'
· Any damage or loss, whether punitive, incidental, or consequential, resulting from direct or indirect use of this website or failure to access pages on this website.
INTELLECTUAL PROPERTY
All content on this website, including itinerary designs, written materials, graphics, and branding, is the property of Nelson & Ivey, LLC and may not be reproduced or distributed without prior written permission.
GENERAL
Nelson & Ivey, LLC reserves the right to change any of the above Terms and Conditions and any information provided on this site without notice.
GOVERNING LAW
These Terms are governed by the laws of the State of Ohio. Any disputes arising under these Terms shall be resolved in a court of competent jurisdiction in the State of Ohio.
